IDENTITY OF THE SELLER

Sarl DU HAMEAU DE PECHARMANT, represented by François-Xavier and Blandine Lesot, registered in the Bergerac commercial register under number B 428 568 968 publishes and operates the online sales site for consumers, at the address https://www.farciesdupech.fr.

Any creation of an Account and/or placing an Order implies acceptance of these General Conditions.

DEFINITIONS

Customer means any consumer placing an Order on the Site. Customers can only be major or minor natural persons represented by their legal representative, acting in a personal capacity as consumers, that is to say, acting for purposes that do not fall within the scope of their commercial activities, industrial, artisanal or liberal.

Order means any order placed by the Customer via his Account, in accordance with the procedure described herein.

Account means the unique account created by a Customer on the Site, using codes issued by www.farciesdupech.fr. The Customer is obliged to create an Account to place an Order.

Products means the products offered for sale on the Site.

Site means the website for the online sale of Products to consumers, developed and operated by Anthony Debras accessible at the address https://www.farciesdupech.fr or any other address that it may substitute.

OBJECT

The purpose of these terms of Sales is to define the conditions and procedures for placing Orders by Customers via the Site, and for the sale and delivery of Products.

Any Customer Order implies unreserved acceptance of these Terms of Sales, which the Customer acknowledges having read by ticking the box provided for this purpose before confirming his Order.

These terms of Sales may be subject to subsequent modifications. The version opposable to the Customer is the one in force on the Site on the date of the Order.

ACCOUNT CREATION

In view of his first Order, the Customer connects to the Site and creates an Account by filling in the fields of the registration area, with a username and password that he chooses. A confirmation message is sent to him at the email address he provides.

The personal data entered by the Customer on his Account is processed by Sarl du Hameau de Pecharmant, according to the conditions and purposes defined in the Privacy Policy of www.farciesdupech.fr.

The Customer is solely responsible for the conservation and confidentiality of the codes. Any Order placed via its codes is deemed to have been made by the Customer. In the event of theft or loss of the codes, the Customer shall inform www.farciesdupech.fr without delay so that new codes can be sent to him.

PRODUCTS

Characteristics

The Customer takes note of the essential characteristics of each Product which appear on the Site.

The Customer is required to refer to the description of each Product in order to know its properties and essential particularities. As such, the Customer declares and acknowledges having read the advice for use and the precautions for use appearing on the description of certain Products. It is the Customer’s sole responsibility to verify that the Product corresponds to his needs.

Sarl du Hameau de Pecharmant is free and sole decision maker of any modification of the Products offered on the Site.

GEOGRAPHICAL ZONE OF DELIVERY

The Products are offered for sale and shipped in metropolitan France.

AVAILABLITY

The offers presented by Sarl du Hameau de Pécharmant are valid as long as they are announced on the Site.

The Products are offered and supplied within the limits of available stocks, which the Customer acknowledges.

PRICES

The Products are supplied at the prices in force appearing on the Site at the time the Order is placed by the Customer. Sarl du Hameau de Pécharmant may modify the prices at any time before any Order.

The prices of the Products are expressed in euros and include all taxes (TTC). They take into account the value added tax (VAT) applicable on the day of the order. Any change in the VAT rate will be automatically applied to the prices of the Products.

The prices of the Products do not take into account the delivery costs invoiced in addition to the price of the Products purchased, under the conditions indicated in the article “Product Order Process”, and calculated prior to placing the Order.

PRODUCT ORDERING PROCESS

The Customer selects the Product(s) of his choice and adds them to his basket by clicking. The Customer can check the details of the selected Products, their price and their quantity by consulting his basket and modify or correct any errors before confirming.

Order

The Order becomes firm when the Customer confirms the purchase of the Products ordered by clicking on the “Validate your Order” button”. The Customer is deemed to have knowingly accepted the content and conditions of the Order and in particular these General Terms and Conditions of Sale, the fact that his Order implies a payment obligation on his part, the prices, volumes, characteristics, quantities and delivery times of the Products offered for sale and ordered by the Customer.

Upon confirmation of the purchase by the Customer, the sale is definitively concluded. The Customer will no longer be able to cancel his Order subject to the exercise of his right of withdrawal defined in the article “Right of withdrawal”.

The Order is confirmed by www.farciesdupech.fr by sending an email to the Customer’s email address. When this email is sent, Sarl du Hameau de Pecharmant collects the price in accordance with the “Payment” article. The copy of the Order is also saved and can be consulted on the Customer’s Account.

The Customer must ensure that the electronic contact details communicated during the Order are correct and that they will allow him to receive the confirmation email. If the Customer does not receive confirmation by email within 72 hours, he can contact the Sarl du Hameau de Pecharmant at the following address: contact@farciesdupech.fr. In this case, the Order will also be considered final.

Sarl du Hameau de Pécharmant will inform the Customer of the status of his Order by email. It is recommended that the Customer keep the emails in paper or electronic form.

The responsibility of Sarl du Hameau de Pecharmant cannot be engaged and the Order remains valid, in the event of an error by the Customer in the information he communicates (e-mail address, delivery address, etc.) or in the choice of Products or their quantity.

DELIVERY OF PRODUCTS

The Products are delivered to the delivery address provided by the Customer for each Order concerned, located in the geographical area covered by the offer of Sarl du Hameau de Pécharmant.

Sarl du Hameau de Pecharmant delivers its Products to the geographical areas under the following conditions:

In all cases, www.farciesdupech.fr undertakes to deliver the Product within 30 days of the sending of the order confirmation email, except in cases of force majeure beyond the control of www. farciesdupech.fr or in case of fault of the Customer.

In the event of exceeding the indicative deadline exceeding 10 working days, the Customer may enjoin the Sarl du Hameau de Pécharmant by Registered Letter with Acknowledgment of Receipt (hereafter, LRAR) or by email to the address appearing in the “Contacts” section. to deliver the Products within a reasonable additional period.

If Sarl du Hameau de Pécharmant fails to perform within this new reasonable period and in any case, at the end of the 30-day period, the Customer may cancel the Order by recorded delivery addressed to Sarl du Hameau de Pécharmant or by email to the address appearing in the “Contacts” section, unless Sarl du Hameau de Pécharmant has complied in the meantime.

Sarl du Hameau de Pécharmant refunds the Order actually collected by Sarl du Hameau de Pécharmant no later than 14 days following the cancellation of the Order. Reimbursement is made in the form of a credit note or reimbursement at the Customer’s choice.

RETURN OF PRODUCTS

Upon receipt of the Products, the Customer checks the apparent condition of the package and the Products, to report any damage, deterioration or shortage in relation to the Order.

If necessary, the Customer strictly complies with the procedure below, failing which he loses any possibility of reimbursement, exchange or recourse against Sarl du Hameau de Pecharmant or its carrier.

RIGHT TO RETRACT

In accordance with article L.121-21 of the French Consumer Code, the Customer has a period of fourteen days from the date of receipt of the Product to exercise his right of withdrawal, without having to justify his decision. The Customer may exercise his right of withdrawal from the confirmation of the Order.

In the case of an Order relating to several products delivered separately, the delivery of which is staggered over a defined period, the period runs from the receipt of the last Product.

When the fourteen-day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.

Modalities for exercising the right of withdrawal.

The Customer informs Sarl du Hameau de Pecharmant of his decision to withdraw by sending him, before the expiry of the 14-day period, the standard withdrawal form appearing in the appendix to these General Terms and Conditions of Sale and/or the return form sent with the Products and/or any other unambiguous declaration, imperatively mentioning the Order number, to the following address:

Sarl du Hameau de Pécharmant acknowledges receipt of the Customer’s withdrawal request without delay and sends him an email to the address he has provided on his Account.

The Customer undertakes to return the Product(s) no later than 14 days following the communication of his decision to withdraw, by tracked parcel or LRAR, making sure to carefully fill in the address of the Sarl du Hameau de Pécharmant above.

The Products are returned in their original packaging.

Customer Refund – Return Costs

In the event of exercise of the right of withdrawal within the aforementioned period and under the above conditions, the Sarl du Hameau de Pécharmant will reimburse the payments received from the Customer concerning the Products subject to the withdrawal, including the delivery costs, at the except for additional costs resulting from the Customer’s choice of a delivery method other than the less expensive standard delivery method offered by Sarl du Hameau de Pécharmant.

The Sarl du Hameau de Pécharmant will reimburse the Customer for all the sums paid or will issue a credit note at the Customer’s choice, at the latest within fourteen days from the date of recovery of the Products.

If the Customer wishes to be reimbursed, Sarl du Hameau de Pécharmant will make the reimbursement using the same means of payment as that used by the Customer for the initial transaction, unless expressly agreed otherwise by the Customer for Sarl du Hameau de Pécharmant to use a other means of payment, and insofar as the reimbursement does not incur additional costs for the Customer.

PROOF

In the event of a dispute, Sarl du Hameau de Pécharmant may validly administer proof of an Order using its connection and transaction logs, which alone shall prevail, in particular with regard to the date, nature and content of the Orders, which the Customer acknowledges.

In addition, the provision of the bank card number and the final validation of the Order constitute proof of the firm and final confirmation of the Customer’s Order and entail the payment of the sums committed appearing on the Order. The registers kept in the computer system of www.farciesdupech.fr and/or its partners constitute proof of the communications, Orders and payments made between the Parties, which the Customer acknowledges.

PAYMENT – MEANS OF PAYMENT

The Site authorizes the payment of Orders by Carte Bleue, Visa, and Mastercard, via the Stripe.com solution.

Payment is made in euros when ordering online via the secure payment system offered.

Securing payments

To pay for his Order, the Customer must use the secure interface offered from the Site.

www.farciesdupech.fr uses a payment system that ensures the confidentiality and security of the transaction.

The pages on which the Customer carries out a transaction (contact details, online payment) use a secure connection.

As part of the fight against Internet fraud, information relating to the Order may be transmitted to any third party authorized by law or designated for the purpose of verifying the identity of the Customer and the method of payment used.

Payment anomalies

www.farciesdupech.fr reserves the right to suspend or cancel any Order and/or delivery whatever its nature and its stage of execution, in the event of non-payment or partial payment of the corresponding amounts, in the event of incident of payment or fraud or attempted fraud in the use of the Site, in particular in the context of previous Orders.
